Ministry of Justice Holds Orientation on Legislative and Legal Mechanisms for Khatam Ul Nabiyeen University Students

The Ministry of Justice explained legislative and legal mechanisms in this Ministry to the students of Jurisprudence and Law of Khatam Ul Nabiyeen University and answered their concerns and questions and received the professors and student recommendations for the betterment of legal and legislative affairs in this Ministry.

This program was conducted on Tuesday Nov 24th by Ministry of Justice and Khatam Ul Nabiyeen University at the meetings’ hall of this university attended by Dr. Mohammad Wahid Benish- Chancellor of the University, Dr. Abdul Ali Mohammadi- Professor of this University and former adviser to the president and a number of lecturers and students.

In this program, the spokesperson of Ministry of Justice explained the functional mechanisms of this Ministry for the students.

He said that the Ministry of Justice based on its Regulation for managing operations, is responsible and works in the field of drafting and processing of legislative documents, addressing legal petitions, defending public and state properties before the courts, providing free of charge legal aid, registering and observing political parties, social organizations and property dealers, and dealing with the relinquishment and attainment of Afghanistan citizenship requests.  Also, the Ministry of Justice is responsible for the chairmanship of Combating Human and Migrants Trafficking Commission and likewise, the mobilization and coordination of affairs related to this phenomena is vested to this ministry.

The spokesperson of Ministry of Justice explaining the process of legislation, said that law drafting is proposed by institutions and the national assembly and then after scrutinization by the Ministry of Justice it is submitted to Legislation Committee and the Cabinet for ratification and following that, it is presented to the National Assembly for the approval.

He said that the drafting and processing of legislative documents require digitalization, reduction of administrative complexities and sharing their draft with scholars and experts and in this regard, the Ministry of Justice would welcome the suggestions of professors and students. He also pointed out to the plan of this Ministry for the digitalization of legislative processes and said that this process will be in accordance with new standards and methods.

Mr. Riazat added that the Ministry of Justice is also responsible to address citizens’ legal cases prior to referring to courts and registers and addresses citizens’ family related cases, real estates and debts. He explained to the students the work processes of Huqoq Department and said that efforts are made to shorten this process considering the fact to ensure justice among parties. He said reconciliation among parties to the dispute is one of the main things that needs concentration.

He further said that Department of State Cases of Ministry of Justice works in the area of prevention of usurpation of public properties and filing lawsuit against usurpers before the courts and in the meantime the obligation of this department on prevention of usurpation is depended to provision of information and documents by the institutions and people on public and state land usurpations. He said that the Ministry of Justice welcomes the viewpoints of students and professors for better and effective achievements of this department.

Likewise, the spokesperson of Ministry of Justice explained the working procedure of legal aid department, appointment of defense lawyers for the accused indigents and informing people about their rights and obligations and said however the resources of Ministry of Justice are limited but tries to provide the opportunity of appointing defending lawyers for the accused indigents to guarantee fair trail across the country and also legal awareness methods need to be renewed and effective. He asked the participants to take part in legal awareness which is a national responsibility of all.

Registration and review of political parties and social organizations in Ministry of Justice is another responsibility of Ministry of Justice which has been discussed about it in this orientation. The spokesperson of Ministry of Justice said, however more than 70 political parties and more than 3 thousand social organizations are registered, but their mobilization and effectiveness is rarely perceived. As he believes, continuous monitoring of these organizations is difficult due to limited human and financial resources and therefore part of monitoring process depends on awareness and participation of responsible citizens.

Spokesperson of Ministry of Justice explained the activities of commission to combat human and migrants trafficking which this ministry has the responsibility of its chairmanship and secretariat.

He in another part of this program, responded to concerns and questions of students about legislative process and other responsibilities of the Ministry of Justice and welcomed their suggestions for the effectiveness of activities. Sharing of draft laws with university’s professors and law students, simplification of law terminologies, multiplicity of laws and ways of monitoring of political parties and social institutions were the main issues the students asked about and provided their suggestions.

In this program, Dr. Qasim Ali Sadaqat also spoke about the challenges in laws and legislative processing. He emphasized the need to respect Islamic law, global standards and the provisions of the Constitution in the legislative processing.

He stressed on the observance of human and Islamic beliefs in legislation processes and said the responsible individuals must believe in these values. He further said that the mobilization and credibility of laws and challenges in the process of legislation depends to this issue.

Mr. Sadaqat also considered important the simplification of terminologies in laws and sharing of draft laws and legislative documents prior to finalization with universities and professors and said such approach will help coordination in the area of producing effective laws.

The Ministry of Justice is supposed to conduct orientation program on working mechanisms of this Ministry for other educational and academic institutions to get viewpoints, suggestions and criticism of academic society to better and make effective the activities of Ministry of Justice. The Ministry of Justice is also committed to make cooperation with educational institutions of the country on the relevant issues.
