Introduction to the Ministry of Justice

The Ministry of Justice of the Islamic Emirate of Afghanistan is a crucial ministry comprises the Minister, the Deputy Minister for Professional Affairs, the Deputy Minister for Financial and Administrative affairs, a Legal and Legislative Advisor, (3) first-grade Directorates, (27) second-grade Directorates, an independent Case Registration System Sub-Directorate at the center, a second-grade Justice Directorate at the national level in each province (total (33) departments), and the Directorate Emirate's Cases (Qazaya-ye Emirate) in Kabul Province.

The Ministry of Justice of the Islamic Emirate of Afghanistan, in order to achieve its vision, carries out the following activities through its relevant units:

  1. In the field of legislation and academic - legal researches:
  • Drafting legislative documents in accordance with Hanafi jurisprudence;
  • Scrutinizing legislative documents draft submitted by ministries and Emirati agencies for processing;
  • proposal for the preparation and processing of legislative documents to complete the country's legal system;
  • Conducting academic - legal researches on legislation;
  • Providing opinions on international treaties and covenants (conventions), in compliance with the principles of Hanafi jurisprudence and applicable legislative documents;
  • Providing legal advice and explanations of legislative provisions to Emirati ministries and agencies upon their request;
  • Providing training to relevant officials of Emirati ministries and agencies in drafting and processing legislative documents;
  1. In the field of defending the rights and interests of Emirati agencies and preserving public and endowed (waqf) properties
  • Collecting evidence and preparing the defense against claims of claimant in cases involving public rights, public interests, Emirati interests, or endowed (waqf) properties.
  • Instituting legal proceedings on behalf of Emirati ministries and other Emirati agencies.
  •  Defending against lawsuits filed by natural or legal persons in courts on behalf of Emirati ministries and other Emirati agencies.
  • Defending public, Emirati, and endowed (waqf( movable and immovable properties in accordance with the provisions of law.
  • Reviewing legal disputes between Emirati ministries and agencies, commissions, authorities, Emirati and mixed companies, and municipalities, and issuing decisions based on mutual agreements between them.
  1. In the field of providing free legal aid:
  • Providing legal advice to indigent suspects, defendants, and convicts, as well as to women and children involved in family disputes.
  • Defending the rights of indigent suspects, defendants, and convicts

  • Conducting legal awareness programs for the public
  1. In the field of regulating the affairs of defense attorneys:
  • Regulating matters related to defense attorneys.
  • Registration, issuance, and renewal of defense attorneys' licenses.

  1. In the field of regulating the registration affairs of associations (charitable foundations assisting the poor and indigent and fair unions among small business owners), and real estate and petition writers:
  • Registration of associations (charitable foundations assisting the poor and indigent and fair unions among small business owners), and monitoring of their activities in accordance with the provisions of legislative documents and related procedures.
  • Registration and issuance of licenses for real estate and petition writers in accordance with the provisions of the law.
  • Monitoring of the operations and activities of real estate offices in accordance with the provisions of the law.
  1. In the field of publishing legislative documents, jurisprudential-legal articles, and characteristics and trademarks:
  • Publishing legislative documents, treaties, international covenants, and other relevant international legal documents in the official gazette and the related website.
  • Publishing and characteristics and trademarks in the official gazette and the related website.
  • Publishing academic-legal articles in the Journal of Adalat, on the website, and in other relevant media.
  • Publishing weekly publications, brochures, posters, and legal messages through the media to raise legal awareness among fellow citizens.
  • Management of the database of laws and other legislative documents.
  • Publishing related work proceedings, meetings, reports, and activities.
  • Stablishing communication with the media and providing information to them as necessary.
  1. In the field of translating legislative documents and notarizing the translation of official documents.
  • Translation of legislative documents into the official languages of the country and, if necessary, into international languages.
  • Translation of the laws of other countries into one of the languages of the country, if necessary.
  • Notarization of the translation of official documents upon request, in accordance with the provisions of the law.
  • Issuance of licenses for the translation of official documents, in accordance with the provisions of the law.

The Ministry of Justice of the Islamic Emirate of Afghanistan is determined to implement Islamic Sharia by adhering to the policies of the Islamic Emirate of Afghanistan while safeguarding national interests and concerns in legislative matters, includes defending Emirati resources and assets, providing legal assistance, offering legal advices, and raising public legal awareness in various fields such as defense attorneys, unions, charitable foundations, real estate, petition writers, and in the area of translators in translation offices, issuances and renewal of licenses, it will carry out its activities in complete coordination with the relevant directorates and support units
