Minister of Justice: “A Key Factor of Non- Implementation of Laws is Their Aggressiveness”

Qanunpooh Fazil Ahmad Manawi, Minister of Justice, attended and spoke at the fourth round commencement ceremony of the legislative stage of this ministry. He stated at this ceremony that, complexity and pugnacity of the law is one of the reasons for its non-implementation in society.
Commencement ceremony of the fourth round legislative stage of the Ministry of Justice was held in Kabul on Tuesday February 9th, and 93 graduates of this round were awarded graduation certificates.
Minister of Justice, over the course of his speech at the above mentioned ceremony, besides offering his congratulatory remarks to the graduates stated that, the society has been led towards the rule of law; but reaching this goal depends upon our strives and efforts. He asserted that, currently, the problem due to lack of professional cadres in judicial and justice authorities and legislative sections has been resolved comparing to two decades ago; however, these professional cadres are required to be more enhanced so as to help the rule of law process.

Moreover, he added that, comprehension, possession, facilitation and implementation of law has a direct impact on the rule of law. He stated that currently we have law in different part, but its comprehension is more important for both the legislature and those who affected by it.
Referring to the simplification of laws, Mr. Manawi added that, we have serious problem in this area, because in the past, our legislative documents were influenced by Arabic language and now our new legislative documents have been influenced by English and other foreign languages. Therefore, he said that, simplification of these terms into our national languages is an absolute necessity, yet nothing has been done in this regard, so one program of ministry of justice is to work seriously in this field.
In another part of his speech, the Minister of Justice said: "Unfortunately, our laws are aggressive, and every office which prepare the draft law for itself, strive to monopolize all power and authority and to increase the dominance of the respective government office; while the law is codified in order to regulate the relationship amongst people, government and institutions”.

Furthermore, the minister of justice accentuated that, “We do not intend to represent absolute governmental power, but the aggressive spirit of law exists from the past, resulting in non- implementation of them in the country”. We wish this spirit to be altered and state administrations ought to be in people’s service and facilitate their lives.
Referring to the problems in the implementation of laws he said, it is needed to convene programs to examine the modality of law implementation as well.
In this ceremony, Dr. Glulam Haidar Allamah Deputy General Attorney in judicial prosecution of General Attorney, Abdul Majed Ghanizadah- General Director of Legislative Affairs Institute of Ministry of Justice and some graduates of legislative stage spoke as well.
The fourth round legislative stage of Ministry of Justice was convened for 93 people who passed the entrance examination successfully in the year 2020 and the enrollment of new stagers for the coming year is to be commenced within just a few days.
