A brief report on the activities of General Directorate of Legislation

A committee under the chairmanship of General Director for Legislation Affairs Mawlawi Saaedullah Hanafi has reviewed the differences of legislative documents of the first period of the Islamic Emirate of Afghanistan with a number of laws which have been substituted in previous regime in order to ensure that the provisions and cases of these documents are not in conflict with Sharia (Islamic Law). This process has been going on until now and some laws the differences of which have been reviewed are the Law on Emirate Cases, Law on Real Estate Agencies and likewise.

Similarly, the General Director for Legislation Affairs discussed the related issues with representatives of UNAMA rule of law and human rights divisions. At this meeting the General Director for Legislation Affairs provided sufficient explanation in relation to the policy of the Islamic Emirate regarding international documents saying that if these documents are not in conflict with Sharia (Islamic Law) and Hanafi Jurisprudence, the Islamic Emirate will not have any specific consideration about them.   

In addition to that, General Director of Legislation Affairs has prepared a draft decree of His Highness Amir Al-Muminin Sheikh Hebatullah May God protect him based on which the fate of laws of previous periods will be clarified and with the issuance of this decree the legislative documents which are not in conflict with Islamic Law and Hanafi Jurisprudence shall be considered as binding laws.

Other significant task being carried out by the general directorate of legislation is sending circulars to different departments and ministries of emirate which in the light of the ratification of Islamic Emirate of Afghanistan will oblige all state administrations to review their relevant binding legislative documents in its relating areas and report to the Prime Minister Office in case of any administrative or Shari problems. Likewise, in this circulars, some plans which have not been finalized yet, have been returned to the respective departments in order to be studied and scrutinized in the light of Islamic Sharia and Hanafi Jurisprudence and sent to the Ministry of Justice for further processing and executions.
