Relinquishment and Acquirement of Afghanistan Citizenship
General Information:
The Ministry of Justice of Islamic Republic of Afghanistan has the duty to process the applications for relinquishment and acquirement of Afghanistan citizenship, and in this regard, the Foreign Relations Department of this ministry and the relevant Commission are functioning.
The Commission on relinquishing and acquiring the citizenship dossiers is chaired by the Deputy Minister for Professional Affairs of the Ministry of Justice and includes representatives from the Ministry of Foreign Affairs, the Supreme Court, the General Directorate of National Security and the National Statistics and Information Authority.
The process of Relinquishment and Acquirement of citizenship is carried out by a written request of the applicant and is based on the law of Relinquishment and Acquirement of Citizenship.
Process of relinquishing citizenship: In order to relinquish the citizenship, the applicant first submits his/her Afghan citizenship application with the required documents to the Afghan embassy or political representation in the second (respective) country.
In the second step, these documents, which include the original application, three filled out forms of renunciation of citizenship, a copy of ID, non-criminal responsibility form and two sheets of the original fingerprints, are sent to the Ministry of Foreign Affairs and then to the Ministry of Justice.
The Ministry of Justice then sends a copy of the documents to the National Statistics and Information Office, the General Directorate of Revenue and Customs of the Ministry of Finance and the General Directorate of National Security of Afghanistan.
After ensuring that the applicant does not have a criminal record or financial liability and is a citizen of Afghanistan, his/her renunciation of citizenship case will be examined by the Commission for renouncing and Acquisition of Citizenship.
The case is then sent to the Director General of the Administrative Office of President for confirmation by the Cabinet and approval by the President. The relinquishment of citizenship application is sent to the Ministry of Justice after receiving the President's decision, and the Ministry of Justice sends a copy of this decision to the Ministry of Foreign Affairs, from where it is sent to the Afghan embassy or political representation in the second country. This way, the process of renouncing the citizenship of the applicant is completed.
Process of acquiring citizenship: In the process of acquiring citizenship, the applicant for citizenship initially submits the application for citizenship of Afghanistan to the Afghan embassy or political representation in the second country or the Ministry of Foreign Affairs of Afghanistan.
The application must be accompanied by the required documents, including three completed citizenship forms, two fingerprints, copies of the marriage certificate, the identity card of one of the Afghan couples, the applicant's passport and entry visas to Afghanistan, and residence documents for more than five consecutive years in Afghanistan, the applicant's resident card and clearance certificate are sent from the Ministry of Foreign Affairs to the Ministry of Justice.
The Ministry of Justice sends these documents to the Statistics and Information Office and the General Directorate of National Security for the purpose of receiving information, and after receiving the approval of the mentioned departments, the case is reviewed by the Commission on Relinquishment and Acquirement of Citizenship.
After reviewing, the citizenship application file is sent to the Directorate of Administrative Office of President for approval in the cabinet, after which the president announces his decision for the citizenship of the applicant.
After the order is announced on the acquisition of citizenship, this announcement is issued for further follow up to the Ministry of Justice, the Ministry of Foreign Affairs and the General Directorate of National Security, and thus the process of acquiring citizenship is completed.
